File an affidavit of Non-abandonment of the property, when a foreclosure takes place the sheriff files an affidavit of abandonment.
All property is considered "abandoned" including your sons and daughters.
Do a living Trust and include your property.
Also, do a land patent.
File a UCC-1 on your property in your state, lien it for over a million.
Until you CLAIM your property it is up for grabs.

Question. Are you supposed to file your UCC in the county as well? In my county, the only place to "record" is in the county land records. Of course if it does not pertain to land, they won't accept it. Then of course if there is any dollar amount associated with the transaction, they want you pay tax. What do you suggest?

Look through your mortgage documents, you will see a release of mortgage document with your signature. This documents states that the mortgage has been satisfied. Do a living trust and attach this document to the living trust. file a UCC-1 into the secretary of state and attach your living trust with the release of mortgage doc.
then make an affidavit of non abandonment.
Get your Ucc # from the state and make an affidavit of CLAIMS, on that affidavit you are claiming the property. Take the affidavit with CLAIMS and affidavit of non abandonment with the UCC-1 attached and file that into the foreclosure. now its "by law" recorded.
After the court stamps the affidavit of claims with the attached affidavit of non abandonment, ucc-1 living trust, and release document, go to the local county news paper and file as a public or legal notice, after 3 weeks your claims are perfected.
after the weeks, file to adjudicate per RES JUDICATA and an affidavit of distress against the judge, bank and lawyers representing the bank....the matter is settled and the bank no longer has any standing.
Now, look into land patents and patent your land.
