It is much easier to 'avoid' dealing with liens and levies if you do your homework in advance 'before' problems arise which is what the IRS FREEDOM PACKAGE is designed to do.   But alas, a majority of people don't wake up until they get stung, so let's deal with it.  

By law,  IRS agents have no authority to seize property in payment of income taxes. They are actually barred by both Federal law and state law from doing so.  However they illegally seize property all the time from an unsuspecting and cowed public who don't understand the maze of regulations.

They get away with it because of the total incompetence (or unwillingness) of America’s legal establishment to protect the public from IRS thievery, and because of the protection the IRS gets from its partners in crime, the Federal judiciary and the U.S. Department of inJustice.

You can actually sue IRS agents who seize your property or 3rd parties (such as banks brokerage firms, employers) that turn over your property to the IRS in response to benign, IRS Notices of Levy.

The “Lien and Levy” packet which is included in the IRS FREEDOM PACKAGE provides documents that should allow you to stop IRS agents from seizing (i.e. “stealing”) your property without legal authority.  It also includes letters and documents that (according to law) should allow you to stop 3rd parties from turning over your property to the IRS in response to their benign notices of levy, provided that they honor the law.

If such 3rd parties willingly disregard the law contained in these letters and documents and turn over your property to the IRS without legal authority, you will have set them up for a civil lawsuit and/or commercial lien in which you should be able to recover from them far more than what they turned over to the IRS.

The documents that come with the Packet, will allow you to confront IRS agents with proof that they have no authority to file liens against you or seize your property in connection with income taxes.

Here's what the IRS Lien & Levy Packet, included in the IRS FREEDOM PACKAGE contains; 

  1. - Affidavit: Statement of fact including points of law which establishes that the IRS Agent trying to collect is not properly authorized by law or by the IRS' own guidelines with the necessary 'enforcement' authority to forcibly collect property in lieu of 'income taxes'. 

  2. - Sample Letter 'to' a third party: Informs any third party such as your bank, employer, brokerage house, etc. of the necessary legal requirements which must be in place in order for them to turn over your property without your consent.  This letter includes the points of law and is sent to the Legal Counsel of the third party to verify and confirm to help the third party recipient of the letter avoid serious liability by taking any mis steps in any attempted distraint by the IRS. 

  3. - Sample letter 'from' a third party to the IRS:  This is a letter you can prepare 'for' your bank or employer to send to the IRS in response to any request from the IRS that the third party turn over your private property.  It essentially empowers the third party to demand that the IRS conform to the law and present those legally mandated requirements prior to asking the third party to participate in distraint on your private property.   This is important for the thrid party bank or whomever, to be able to act lawfully, with conscience and avoid liability.
     
  4. - Sample letter to the County Clerk and Recorder:  In regard to the public filing of 'Notices of lien' this letter points out the pertinent aspects of law for a 'valid' Lien to be filed.  Absent those requirements (as in the instant case) the County Recorder is acting outside the law and assuming personal liability for 'ultra vires' acts.  This letter, with those authorities, requests that the County Recorder remove any unlawful 'Notices of Lien'. 

These sample letters and the legal memorandum they contain should be sufficient to properly establish who is acting in good faith, and who is not.  If they are acting in good faith, any NOTICES OF LIEN or Levies will be prevented, or removed whenever they are improper (which is almost always).  Any actors who do NOT operate in good faith and willingly violate the law and your property rights, set you up for an entirely new opportunity!
